[1] This is an application for leave to appeal against a judgment and order of the Supreme Court of Appeal.[1] That Court upheld an appeal by the second respondent, Rhino Oil and Gas Exploration South Africa (Pty) Limited (Rhino), and set aside the decision of the High Court of South Africa, Western Cape Division, Cape Town (High Court).[2]
