The GOOD Party welcomes the High Court ruling which has declared the actions of Operation Dudula xenophobic and unlawful. We have consistently condemned the blocking of hospitals and clinics by members of Operation Dudula as not in line with our Constitution or our legal framework.

Our courts have repeatedly affirmed the right of immigrants to emergency healthcare, recognising that denying this right would breach South Africa’s international human rights commitments and the constitutional right to life enshrined in the Bill of Rights.

It is the duty of the Department of Home Affairs and the Border Management Authority, in tandem with the South African Police Force and the South African Defence Force, to protect against illegal immigration, not vigilantes. 

Any parties, political or otherwise, which would like to change the law, or our Constitution should do so through legal means, and not by taking the law into their own hands.

The reality is that it is South Africans, such as those behind the looting at Tembisa Hospital and the tragedy of Life Esidimeni, that are the reason for the terrible state of our healthcare system, not immigrants.
