Over the past decade, Labour Guide has presented numerous courses on the Administrative Adjudication of Road Traffic Offences Act (AARTO) and its potential impact in the workplace. While this legislation has been in development since 1998, with various implementation dates announced by the Department of Transport, it remains only partially in effect, currently limited to Johannesburg and Pretoria, and without the nationwide application of the demerit point system.

Recently, misinformation has circulated regarding the Act’s full implementation. One report incorrectly claimed that AARTO would come into effect nationwide on 5 June 2025. Another report, quoting the City of Cape Town, suggested a rollout date of 1 October 2025. However, no official effective date has been announced by the Minister of Transport, and such claims cannot be confirmed at this time.

We have also noted an increase in training providers offering AARTO courses based on these unverified dates. In our view, some of these advertisements are misleading and may be intended to instil undue fear in employers in order to secure bookings.

Furthermore, Labour Guide maintains that high-quality training on AARTO is not currently feasible, as the proposed amendments to the AARTO Regulations, published for public comment in 2020, have not yet been finalised or officially promulgated. The current regulations are outdated and do not align with the Act as amended in 2019.
